The Victorian Government, through the Victorian Building Authority (VBA), introduced new mandatory laws at the end of 2019 stating all pools/spas must be registered (by the owner) through their applicable local Council. In doing this, the owner must then ensure their fence/barrier is compliant with the relevant standard applied to the build date of their pool/spa and provide confirmation documents to their Council to reflect this.

- Carry out your Compliance Inspection in the most professional manner.
- A certificate of compliance (Form 23) will be issued if we find that your fence/barrier meets the relevant standards.
Should your fence/barrier not comply then generally we can issue you a works direction notice under 147ZG allowing you up to 60 days to rectify any issues before carrying out a further inspection. The direction notice will clearly set out any areas of concern and offer you practical solutions to attend to these items. At this time there are no external penalties applied.
Only in circumstances where your fence/barrier poses a significant and immediate risk to life (under clause 147ZF of Building Regulations 2018) will a certificate of Non-compliance (form 24) generally be issued.
To assist you in preventing a Form 24 Non-Compliance being issued, we strongly suggest that you engage My Pool Fence Inspector to carry out a Pre-Inspection report to gain a one-on-one solution. Alternatively use the attached VBA Self-Assessment Checklist to assist you in understanding your obligations.






- Carry out a detailed onsite analysis of your existing fence/barrier.
- Provide a detailed report on any identified risks with your existing fence/barrier.
- Provide practical solutions to help you remedy these risks so that your pool fence/barrier will comply.
- Assist you in understanding your obligations as a pool/spa owner with ongoing maintenance of your fence/barrier.
Please note that this service is not an official pool barrier inspection but rather a service that will assist you in preparing your fence/barrier for your compliance inspection. This may be of benefit where your barrier may require significant alterations or modifications to comply with the relevant standard applied to your pool/spa. In particular when your compliance obligations are not imminent.
Our pre-inspection consultation service operates under the same obligations as a compliance inspection in that where your fence/barrier poses a significant and immediate risk to life (under clause 147ZF of Building Regulations 2018) will a certificate of Non-compliance (form 24) generally be issued.

This is required if your fence/barrier has had a works direction notice served under Clause 147ZG and 147ZH of the Building Regulations 2018 and has not quite met the standard required upon first inspection.
We will carry out an inspection with the same care and due diligence required to assist you in your fence/barrier complying with the relevant standard.
A Form 23 of Compliance will be issued if your fence/barrier is made compliant with the relevant standard.
A Form 24 Non-Compliance will be issued if you have exhausted the parameters allowed under both 147ZG and 147ZH. This is not taken lightly, and we will endeavour to try our best at educating you prior to these steps taken. Penalties can and will generally apply at this stage and matters are then taken up and dealt with through your local council.
Please note that Re-inspections will operate under strict timelines and your obligations under the Building Regulations 2018 are definitive. We will continue to assist you in the best way possible to prevent external penalties being applied.
